Terms and Conditions

Contract

Keep in mind that it is essential to read and understand the following terms and conditions. This is a contract between you and Machupicchu Tourist Connection S.R.L. When you make your reservation and pay your deposit, you acknowledge that you have read and accept the following terms and conditions. Also, make sure you have read and understood the itinerary and the travel style in which you will participate.

These are the terms and conditions that govern the relationship between Machupicchu Tourist Connection S.R.L .., hereinafter "Machupicchu Tourist Connection S.R.L." or "the company" and you, hereinafter "customer".

Prices of programs and services

All prices are indicated in US dollars and include all taxes for non-residents of Peru. All air and bus fares are subject to change and availability. They will be confirmed on the purchase date of the ticket.
All group departure prices are based on a shared double occupancy. If you are a single traveler, you will be compared to another traveler of the same sex or you can pay a single supplement. All payments made by credit card are subject to an additional fee.

Reservations and Deposit

All Tours:
At the time of booking a 50% non-refundable deposit is due to reserve your walk, and full payment is due 30 days before the start of the hike. If a reservation is made within a period of 30 days of a walk or tour, the entire reservation must be paid in full at the time of booking. Keep in mind that the Inca Trail must be booked well in advance as government permits may be exhausted until 5 or 6 months ahead of time. Please consult us for availability.

Cancellation of services by the client.

Any cancellation made by the client, before 30 days, will result in the loss of your deposit. Cancellations after this time will result in the loss of all money paid.

Cancellation by the company.

The company will only cancel a tour for the following reasons:

• "Major force" (see below)
• Unforeseen circumstances beyond the control of the company.
The company will inform the client as soon as possible of a cancellation. Customers who have a fully paid reservation can choose between an alternative trip when possible or a full refund. The company is not responsible for unforeseen expenses incurred by the client as a result of the reservation, such as visas, vaccinations, non-refundable flights or loss of enjoyment, etc. If the alternative trip chosen has a lower value than the one originally booked then you are entitled to a refund of the difference in price. If the chosen alternative route is of a higher value, the customer will pay the difference in the price.
Please note that refunds will not be given for the following:
• Lost travel time or replacement of facilities.
• Presence of circumstances beyond the control of the company that require alternative arrangements to ensure safety and enjoyment of your route.
• Services not used for any accommodation, activity or travel segment without prior notice.
• Premature termination of the contract

Unused services

If, for any reason, the transport chosen by the client (bus, flight, train, etc.) does not arrive at the destination before or at the scheduled date and time to begin the services contracted by the company, the company will not be retained. responsible for the resulting lost services. The company will begin to provide services from the date of arrival of the client until the originally scheduled completion of the services. Any service lost as a result of these delays is not reimbursable. If the client leaves the tour ahead of time, which includes not using additional nights of accommodation for any reason, voluntary or involuntary, the money will not be refunded.

Prices and surcharges

As we publish our prices well in advance, we may occasionally face significant cost increases due to factors over which we have no control. As such, we reserve the right to impose surcharges (price increases) up to one month before departure if government or other actions force us to do so; such cases include, among others, significant changes in exchange rates, increases in entrance fees, train fares or other taxes on transportation costs. Any surcharge or price increase will be fully explained and justified by the company before implementation. If any surcharge results in an increase of more than 10% of the cost of the program, the client can cancel the reservation and obtain a full refund, minus the expenses already incurred, provided that the cancellation is made within the required period of time.

Meals included

On all flights and ground transportation, meals and refreshments are delivered to the passengers in agreement with the transportation company. Some programs include the meals specified in the itinerary. These are described as B (breakfast), L (Lunch), D (Dining). All other meals are the responsibility of the customer.

Flexibility

The client appreciates and recognizes that the nature of travel to developing countries requires considerable flexibility and should allow alternatives. It is understood that the route, schedules, itineraries, services and mode of transport may be subject to modifications without prior notice due to local circumstances or events, which may include illness or mechanical breakdown, flight cancellations, strikes, events derived of political disputes, entry or border difficulties, climate and other unpredictable circumstances. If the hotels need to be changed, they will be replaced by hotels of a similar level.

Factors beyond the control of the company (Force Majeure)

The company will do everything possible to minimize the effects of matters beyond its control, but can not accept any responsibility for these matters, which include, among others, political disputes, border closures, rejection of visas, industrial actions, flights delayed, unpredictable weather, landslides, etc. The customer agrees to assume all additional costs derived from any of these factors.

Authority on the Tour

At all times, the decision of the leader or representative of the company will be final in all matters that may endanger the safety and welfare of the tour. When booking with us, the client agrees to comply with the authority of the tour guide or representative, who represents the company. If the client decides not to comply with the decisions made by the company representative, the client will be considered to have left the route. The customer must at all times strictly comply with the laws, customs, foreign currency and drug regulations of all countries visited. If the client is affected by any condition, medical or otherwise, that may affect the enjoyment of the excursion by other people, the client must inform the company at the time of booking. Acceptance of risk

Some of the company's itineraries have been designed to provide participants with an exposure to the true nature of the environment visited. EXCLUSIONS OF THE TOUR PRICE

The following items are excluded from the price of the trip:
• Travel to and from the starting point of the trip.
• Personal travel insurance.

• Meals, transportation costs, entrance fees, accommodation costs or other expenses not described in itinerary.
• Laundry, postage, personal clothing, medical expenses and other personal items.

OVERWHELMING FORCE

AIRLINE

AGE REQUIREMENTS: apply only to TREK reservations

We do not accept TREKKING reservations for children under 8 years old and adults over 68 years old. MEDICAL DISCLOSURE

People with heart problems, knee problems, severe asthma or who are more than 18 weeks pregnant should not participate in the walks, but can participate in non-trekking tours by providing our medical form signed by your doctor. People with mild asthma, diabetes or who are pregnant for less than 18 weeks, should bring a medical letter from their doctor indicating they are able to undertake a walk. TRAVEL DOCUMENTATION

INSURANCE

It is mandatory that all clients obtain travel insurance that covers personal injuries, medical expenses, repatriation expenses and evacuation expenses. The insurance policies must cover high enough altitudes to include all the altitudes in which the client will be present. Customers must be able to provide proof of insurance to the company representative. It is strongly recommended that the client's insurance also cover cancellation and interruption, reduction, loss of belongings and all other expenses that may arise as a result of loss, damage, injury, delay or inconvenience that occur to the client. The company will have no responsibility for loss, theft or damage of luggage or personal effects. CLAIMS AND CLAIMS

Applicable law and choice of fórum

This agreement will be governed by the laws of Peru. Each of the parties agrees the exclusive jurisdiction of the Federal Court of Peru in Cusco, Peru, with respect to any action or proceeding related to this agreement.
